The Democratic Legitimacy of Global Governance

Steven Wheatley is a Reader in International Law, and Co-Director of the Centre for International Governance at the University of Leeds.His current research agenda is concerned with The democratic legitimacy of global governance (with a particular focus on international human rights law). According to the traditional understanding, the system of public international law is constituted by a complex web of voluntary legal relationships between sovereign and independent States. The Westphalian paradigm is no longer the whole story. Non-State actors play a significant role in a system of international governance without government in which international organizations and networks establish legal norms. Significantly, consent is no longer a requirement for the establishment of obligations at the level of international law, raising important questions around 'democratic legitimacy'
