Research Interests

My research interests lie within the areas of comparative constitutionalism, European human rights, and legal transition. My monograph, From Old Times to New Europe: the Polish Struggle for Democracy and Constitutionalism (Ashgate, 2010), considers Polish constitutional and legal developments and their legal philosophical contexts starting with the pre-war period in 1918. An analysis of Polish developments serves as a valuable blueprint for other post-dictatorial states.

My research on European human rights jurisprudence concerns the abolition of the death penalty in post-Communist states. I have lectured on European and US Approaches to the Death Penalty to Amnesty International (Lancaster branch). I have also published on the issue. My latest piece concerns the European position on the abolition of the death penalty, which inevitably requires a closer consideration of European values and identity.

More recently, my work concerns post-transitional justice in post-Communist, new Europe. My research on Romania was funded by the British Academy Small Research Grant and the SLSA (Socio-Legal Studies Assocation) and involved interviews with military prosecutors in cases against members of the Romanian Communist Party and the notorious security police, the Securitate. My investigation extends to Poland and Albania. The Polish approach to transitional criminal justice was the subject of a paper I delivered at a workshop on 'Transitional Criminal Justice in Post-Dictatorial Societies', in Bucharest, 29-30 October 2010 (see http://www.crimelecomunismului.ro/en/). The research for this paper was funded by the FASS Research and Development Fund.

Another important dimension to post-transtitional justice concerns the judiciary and the misadministration of justice. Judicial identity was the focus of apaper presented at the Estonian Institute of Historical Memory's conference on the 'Shaping of Identity and Personality during Communist Rule: History in the Service of Totalitarian Regimes in Eastern Europe', Tallinn, 9-10 June 2011 (see http://www.mnemosyne.ee/lang/en-us).

In December 2011, I participated in an Academic Forum on the 'Burdens and Opportunities of the Past' (along with Andreja Valic, the Head of Slovenian Study Centre for National Reconciliation)sponsored bythe School of Government and European Studies in Brdo, Slovenia (see http://www.fds.si/dejavnosti/akademski-forum/821-evropsko-drzavljanstvo-bremena-in-priloznosti-preteklosti).
