Law 310 - Human Rights and Civil Liberties(Half Unit in 1st term) ConvenorDr Agata Fijalkowski THIS COURSE WILL BE WITHDRAWN, IF SENATE APPROVES THE FULL UNIT LAW 328 – HUMAN RIGHTS AND CIVIL LIBERTIES This course studies the legal protection of civil liberties and human rights in the United Kingdom, in the European context. It is concerned with the powers that the state often seeks to 'protect' individuals, interest groups and even the state itself. A critical and contextual approach to the subject of civil liberties and human rights is adopted when exploring the theoretical foundations for the existence of freedoms and rights that includes the legal mechanisms through which freedoms and rights are secured and protected, as well as the justifiable limitations on freedoms and rights. Case studies are used to further illustrate the key issues and questions. The course examines the legal protection offered by domestic law in the United Kingdom, considering case law relating to the Human Rights Act 1998. Issues, such as the right to life, freedom of expression, the exercise of police powers, and an examination of the ways in which terrorism effects our civil liberties, will be considered. This half unit is available to second and third years. AssessmentCoursework 50%, Exam 50% Recommended ReadingDavid Feldman, Civil Liberties and Human Rights in England and Wales, 2nd edn.
