LAW 314: Advanced Contract Law

(Full unit taught in 1st and 2nd terms)

This course, which consists of a series of seminars and workshops based around prescribed reading, examines a number of important theories of contract. This will help students to conceptualize contracts more effectively and discover approaches to gain a better understanding of both contract law (cases and statutes) and the phenomenon and process of contracting itself. Analyses covered include Fuller’s “interests” approach, Havighurst’s “uses” of contract, Macneil’s relational contract theory, and Adams and Brownsword’s ideological approach. The first part of the course involves reading original scholarly writings and developing responses to the material. In the second part of the course students will apply the ideas learned to major aspects of contract doctrine, such as agreement and consideration, to gain a better and clearer understanding both of these doctrines and of the theories themselves.

This course is available to final year students only.
