Law 328 - Human Rights and Civil Liberties(full unit) ConvenorDr Agata Fijalkowski THE FOLLOWING IS SUBJECT TO UNIVERSITY APPROVAL. IN THE EVENT OF SENATE REFUSAL, LAW 310 (HALF UNIT) WILL RUN INSTEAD. This full unit course studies the legal protection of civil liberties and human rights in the United Kingdom, in the European context. It is concerned with the powers that the state often seeks to 'protect' individuals, interest groups and even the state itself. The course adopts a critical and contextual approach to the subject when investigating the theoretical foundations for the existence of freedoms and rights and the legal mechanisms through which freedoms and rights are secured and protected, including the justifiable limitations on freedoms and rights. The course examines the legal protection offered by domestic law in the United Kingdom, considering case law relating to the Human Rights Act 1998. Case studies and references to developments in new member states to the Council of Europe are used to further illustrate the key issues and questions.
