Jury Service

1.Policy

It is the policy of the University to recover from individuals who attend Jury Service the daily allowance paid by the Court as compensation for loss of earnings. Staff are obliged to make such claims and the University will deduct from source as though those claims have been met.

2. Preamble

2.1 The University is required by law to give individual members of staff leave of absence to attend jury service as requested by a Crown/County Court.

2.2 The daily attendance allowance is the daily earnings of the juror up to a maximum of 56.96 (May 2006). If attendance exceeds 10 working days the allowance doubles for the additional days thereafter.

3. Procedure

3.1  As soon as they have been told that they are required for jury service, the member of staff should forward the Jurors Loss of Earnings Certificate provided by the court (Form 5223) to their head of department.

3.2  After noting the dates of the jury service the HOD should forward that Certificate to Payroll for completion. Payroll will state the deductions to be made i.e. the salary of the juror or the maximum allowance whichever is the lower.

3.3  On completion of the jury service, jurors must complete the Jury Service Record Form to inform Payroll of the periods they were required as jurors and the periods they were present for work. Returns should be made to payroll within one week of the completion of the period of service.

3.4  Payroll will organise a deduction from salary of the amount representing the value of the allowance for the service period. Please note: the onus is on the individual to notify payroll of periods when they were not required by the Court and therefore available for work, otherwise the University will assume that the juror was required for the whole period and deduct the allowance accordingly.

3.5  In circumstances where deduction of the jury service allowance results in a nil salary payment any additional superannuation contributions due will be deducted from the next available salary payment to provide continuity of pensionable service.
